This paper comments on the International Criminal Court's decision to request an arrest warrant for Sudanese President Omar al-Bashir, the first time the court has considered charges against a standing head of state. The paper also discusses the remit of the the Chief Prosecutor and examines the foundations of the ICC. Furthermore, the paper outlines the risks of pursuing justice while peace has not yer been secured, and what effects the arrest warrant might have on the peace process in Darfur.
